DURHAM, Justice:

This is an unlawful detainer action by P.H. Investment (the landlord) against Cathy Oliver (the tenant) based upon nonpayment of rent. Because of the deteriorated condition of the premises, the tenant argued that she owed no rent and counterclaimed for a rebate of rent paid.
