Plaintiff, Earl Epps Jr., instituted this action seeking damages for injuries sustained in a fall from an allegedly defective step ladder. The accident occurred at St. Mary's Academy School ("St. Mary's"), which is owned and operated by defendant, Society of the Holy Family (the "Society").
