We granted the petition for writ of certiorari in this case primarily to review this question: Was the indictment, which tracked the language of the statute in alleging that Henry Mack Harper "unlawfully" distributed cocaine in violation of Ala.Code 1975, § 13A-12-211, fatally defective because it did not allege that the offense was "knowingly" committed?
