On November 2, 1989 the defendant, Mark Slay, was charged by grand jury indictment with five counts of criminal activity including aggravated rape in violation of LSA-R.S. 14:42. Also included in the indictment were charges of violations of LSA-R.S. 14:37, aggravated assault, LSA-R.S. 14:56 simple criminal damage to property, LSA-R.S. 14:45 simple kidnapping, and LSA-R.S. 14:27, 14:30 attempted murder.
