In this, the third appeal in a case which the parties agree has had a "long and tortured history," appellants seek reversal of a judgment of Madison Circuit Court which they claim impermissibly adjudicated issues which had been rendered moot by their payment into court of funds sufficient to satisfy a previously rendered judgment in favor of the appellee, William D.
