TYSON, Judge.

Donnie Ruffin was indicted and charged with two counts of second degree rape and one count of attempted sodomy in the first degree. The three cases were consolidated for trial. On July 26, 1989, the jury was unable to reach a verdict and a mistrial was declared. The cause was retried, and on August 8, 1989, a jury found Donnie Ruffin "guilty as charged" in all three cases.
