MEMORANDUM OPINION AND RULING GRANTING MOTION FOR SUMMARY JUDGMENT

VIETOR, Chief Judge.

Bhupendra Patel was a guest at the Airport Hilton Inn in Des Moines, Iowa. As Patel exited the shower in his room, he grabbed the handle portion of a soap dish attached to the wall.
