OPINION

BROOKSHIRE, Justice.

A jury convicted William Carroll Hunter of possession of a controlled substance, cocaine, in an amount less than twentyeight grams. The jury found the enhancement allegation true and assessed punishment at forty years' confinement in the Texas Department of Criminal Justice, Institutional Division and a $10,000 fine. Appellant raises three points of error.
