Manuel Ramirez was convicted of possession of a controlled substance (heroin) based upon evidence seized from the front seat of his parked vehicle. On appeal, Ramirez contends that the police obtained the evidence in violation of his fourth amendment rights and that the district court erred in denying his motion to suppress. He also avers that the court abused its discretion by imposing a sentence more severe than that recommended by the state...
