Plaintiff-appellant brought suit against defendant-appellee under 42 U.S.C. § 1983.1 Appellant alleges that the deadly force used by appellee police officer in a prostitution arrest was unreasonable and in violation of his constitutional rights. The police officer shot the appellant causing him to suffer permanent injury. The case was tried to a jury on federal and common law claims.
