SEERDEN, Justice.

This is a summary judgment case. Appellant's cause of action is based upon the claim for damages resulting from appellee's alleged fraud and misrepresentation in connection with her execution of certain notes individually and in her capacities as administratrix of the estates of her son, John Bixenstine, and husband, Cyril Bixenstine, both deceased.
