Plaintiff, Donald Burger, sustained injuries when he fell off a ladder at a construction site. He is suing several defendants, including the owner of the real estate, Prairie Development, Ltd. Prairie successfully moved for summary judgment and was dismissed from the litigation. Burger appeals from that judgment, contending that the court erred in its conclusion that Prairie was not "in charge of" the work for purposes...
