This case returns to us after remand. On the earlier appeal we returned this matter to the district court for a determination whether a tape recording of a conversation between Conrado Gomez and co-defendant Jesus Duran, which was a critical part of the evidentiary base for Gomez's convictions for conspiracy and the substantive offenses of possession with intent to distribute heroin and cocaine, had been made with the requisite consent.
