ARNOT, Justice.

Appellant, Hector Martin Mello, was indicted for delivery of cocaine. Appellant waived trial by jury, and the court found appellant guilty of the lesser included offense of possession of cocaine. Punishment was enhanced by three prior felony convictions and assessed by the trial court at confinement for life and a $35,000 fine.
