Defendants Robert and Eleanor Isham (the Ishams) move for judgment on the pleadings, contending that plaintiff's action for negligence and breach of fiduciary duty is preempted by 12 U.S.C. § 1821(k) of the Financial Institutions Reform, Recovery and Enforcement Act of 1989 (FIRREA).
