I. BACKGROUND

On March 10, 1989, Jimmy Joe Wayland (Wayland) and his wife, Sara Ruth Wayland, were arrested by Springdale, Arkansas, police officers on a warrant for a theft in Kansas. In a search of the Wayland home officers seized a metal cash box stolen from a business in Springdale. Sara Wayland posted her $2000 bond.
