CANNON, Justice.

This is an appeal from the denial of a pretrial application for writ of habeas corpus. Tex.Code Crim.Proc.Ann. art. 11.01, et seq. Appellant is presently under indictment for murder. Tex.Penal Code Ann. § 19.02(a)(1), (2). In a pretrial application for writ of habeas corpus, appellant contended that his prior conviction for injury to a child barred the present prosecution under the doctrine of double jeopardy.
