OPINION

CUMMINGS, Justice.

Appellant was charged by indictment with the third-degree felony offense of forgery by possession. A jury found him guilty and assessed punishment at one year in a community correctional facility and a $5,000 fine. The Court then entered a judgment of guilty but, contrary to the jury's verdict, assessed punishment at one year in the McLennan County Jail and a $5,000 fine.
