Jeaneane McBride and Stephen P. Nick appeal from judgments of the county and circuit courts of Washington County granting summary judgment and assessing them with damages for filing a frivolous lawsuit against The Aetna Casualty & Surety Company. We find the court erred in granting summary judgment, and reverse.
