Spona Byrd was indicted on two counts of illegally disposing of hazardous waste without a permit in violation of § 22-30-19(f)(2) and § 22-30-19(e)(2), Code of Alabama 1975. Subsequently, the appellant was convicted on both counts. The appellant was given a concurrent sentence of five years on each count and was ordered to serve one year of said sentence on the alternative sentencing program with the litter...
