Claiming to be a seaman, plaintiff, J.W. O'Bryan, instituted this suit against his employer, Folk Construction Company, for damages based upon negligence under the Jones Act, 46 U.S.C.App. § 688, and unseaworthiness under the General Maritime Law of the United States. Fidelity and Casualty Company, Folk's worker's compensation insurer, intervened to recover compensation benefits and medical expenses it paid to and on behalf of plaintiff....
