Billy Baker, administrator of the estate of Willie Odell Baker, deceased, appeals from an order of the Hot Spring County Probate Court, contending that it erred in denying his petition that appellee State Farm Fire and Casualty Company, as subrogee, be assessed its proportionate share of the cost of collection of a wrongful death claim. We agree and reverse and remand for further proceedings.
