PER CURIAM.

Petitioner-Appellant Joel Clay appeals from the district court's dismissal of his habeas corpus petition filed pursuant to 28 U.S.C. § 2254. The district court dismissed Clay's petition for lack of subject-matter jurisdiction. We vacate the dismissal of Clay's petition and remand the case for further proceedings consistent with this opinion.
