Defendant, Kelvin Green, was charged by bill of information on June 9, 1989, with possession with intent to distribute cocaine, a violation of LSA-R.S. 40:967(B)(1). At his arraignment on June 27, 1989, he pled not guilty. He was tried by a jury of twelve on March 7 and 8, 1990, and found guilty of the lesser included offense of simple possession of cocaine.
