No. 3-90-0568.

573 N.E.2d 831 (1991)

214 Ill. App.3d 152

158 Ill.Dec. 18

The PEOPLE of the State of Illinois, Plaintiff-Appellant, v. Donald PURCHASE, Defendant-Appellee.

Appellate Court of Illinois, Third District.

April 4, 1991.

Attorney(s) appearing for the Case

Gary F. Gnidovec, States' Attys. Appellate Prosecutor, Ottawa, and Raymond Kimbell, III, State's Atty., Galesburg, for the People.

Thomas C. Maas, Baudino, Potter & Maas, Farmington, for Donald Purchase.

OPINION

Presiding Justice STOUDER.

The defendant, Donald Purchase, was charged with five counts of theft (Ill.Rev. Stat.1989, ch. 38, par. 16-1(a)). The trial court thereafter granted the defendant's motion to suppress all evidence seized during a search of his residence. The State appeals, arguing that the trial court erred in determining that the consents obtained from the defendant and his wife were not voluntarily given.
