The appellant, Jean W. Gentile, was arrested by Guntersville police officer James Patterson on September 14, 1990, and was charged with violating municipal ordinance No. 552 (§ 32-5A-191(a)(2), Code of Alabama 1975). The appellant was adjudged guilty as charged in the municipal court on November 26, 1990. She then appealed to the Circuit Court of Marshall County, Alabama, for a trial de novo.
