Before the Court for a second time is the Motion of defendant, the Southeastern Pennsylvania Transportation Authority ("SEPTA"), for Summary Judgment. In the Complaint, Irving Felton ("plaintiff") seeks damages for personal injuries allegedly sustained while he was employed by SEPTA as a trackman for its City Transit Division.
