Appellant Marc Whitworth was indicted and arrested for felony aggravated possession of marijuana greater than fifty pounds but less than two hundred pounds. Tex. Health 481.121(d)(1) (Pamph.1991). Whitworth pleaded not guilty to the offense. Evidence was presented to the court, which found Whitworth guilty of the offense.
