In this case of first impression, we must determine whether an employee may be charged with aiding and abetting his corporate employer in a criminal violation of The Occupational Health and Safety Act of 1970, 29 U.S.C. § 666(e) (1988) ("OSHA" or "the Act"). We find that Congress did not intend to subject employees to such liability under OSHA, and, therefore, affirm the district court's dismissal of criminal charges against Defendant-Appellee...
