In this case, we interpret the applicability of the criminal livelihood provision of the U.S. Sentencing Guidelines. The defendant, Benny Ray Quertermous, pleaded guilty to one count of knowing possession of stolen mail, a violation of 18 U.S.C. § 1708. He was sentenced to thirty months imprisonment, followed by a three-year term of supervised release, and required to pay restitution in the amount of $1594.
