Eddie Roger Harris was indicted for the offense of possession of marijuana in the first degree, in violation of § 13A-12-213(a)(1), Code of Alabama 1975. The jury found Harris guilty as charged in the indictment, and he received a split sentence of five years, with six days to serve in the county jail and five years' probation for the remainder of the suspended sentence. Three issues are raised on appeal.
