Plaintiff-appellant Johnnie L. Phelps appeals from a district court judgment granting defendant-appellee Fina Oil & Chemical Company's motion for summary judgment and denying Phelps' motion for summary judgment. We have jurisdiction pursuant to 28 U.S.C. § 1291.
