The court has before it the motion for summary judgment filed by plaintiffs on May 21, 1991. Pursuant to the court's order of May 29, 1991, the motion was deemed submitted, without oral argument, for decision as of June 25, 1991. For reasons set forth more fully below, the court concludes that plaintiff's motion is due to be granted.
