The primary issue in this case is whether exhaustion of administrative remedies is a prerequisite to bringing a civil action for age discrimination in employment. Thomas Schroeder sued his former employer, Texas Iron Works, Inc. ("TIW"), for damages for wrongful discharge, asserting causes of action for age discrimination, breach of contract and misrepresentation.
