PER CURIAM:

This is an appeal by John David Sartin from a final order of the Circuit Court of Mingo County dated November 30, 1990. The lower court awarded summary judgment in favor of the appellee Cory Petsche. The appellant contends that the lower court erred in granting summary judgment against him. We agree with the contentions of the appellant and reverse the decision of the Circuit Court of Mingo County.
