The defendant, David F. Wientjes, was charged with possession of marijuana with intent to distribute, a violation of LSA-R.S. 40:966A(1). The defendant entered a plea of nolo contendere and was sentenced to seven years at hard labor. On appeal, the defendant asserts two assignments of error. Defendant argues that his plea is invalid as the trial court did not inform him that, as a third felony offender, he was ineligible for probation or parole...
