MEMORANDUM OPINION AND ORDER

SPORKIN, District Judge.

This case comes before the Court on Defendant's, Kuwait Airways, motion to dismiss based on lack of subject matter jurisdiction and failure to state a cause of action upon which relief may be granted. Because the plaintiff, Basharat Jamil, has failed to state any cognizable claim, Kuwait Airways motion is granted.
