OPINION

JACKSON, Judge:

Appellant ("the conservator") appeals from a summary judgment based on the Medical Benefits Recovery Act, Utah Code Ann. § 26-19-1 to -18 (1989).1 The trial court granted Utah Department of Social Services' ("the State") motion to recover state medical assistance payments provided for Aundrae Higley ("Higley"), minor son of the conservator.
