MEMORANDUM OPINION

CACHERIS, District Judge.

The plaintiff, Edward L. Jolly, alleging that the defendant, Northern Telecom, Inc. ("NTI"), discriminated against him on the basis of race, instituted this action under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (Count I) and the Civil Rights Act of 1866, 42 U.S.C. § 1981 (Count II).1
