O'CONNOR, Justice.

This case involves whether the party made a timely request for a jury trial. We reverse and remand for a jury trial.

David Baugher, plaintiff, and Peter Whiteford, defendant, were businessmen who jointly owned four corporations between 1975 and 1977.
