The State Department of Transportation appeals a judgment which finds it fifty percent (50%) at fault due to an alleged street defect which caused injuries to the plaintiff, Rose Brehm.

Mrs. Brehm fell while crossing General Meyer Ave. and sued the City of New Orleans and the State based on negligence and strict liability. The State stipulated that it owned and had the responsibility to maintain this street. The City filed an exception of no...
