This case involves the efforts of Illinois natural gas distribution companies (distributors) to pass through to their customers the "take-or-pay" costs which the Federal Energy Regulatory Commission (FERC) requires distributors to pay to help relieve interstate gas pipeline companies (pipelines) of the pipelines' take-or-pay obligations to gas producers. The pipelines' liability arose from long-term contracts...
