O'Reilly brought this action, pursuant to 42 U.S.C.A. § 1983 (West 1981), claiming that in denying him a Passenger Vehicle License (PVL) the County Board of Appeals for Montgomery County, Maryland (the Board) violated rights guaranteed to him under the commerce clause and the privileges and immunities clause of the United States Constitution.
