Appellee, Raul Sergio Torres, was indicted for the felony offense of escape. Tex. Penal Code Ann. § 38.03. The trial court dismissed his case for want of prosecution. The State reindicted appellee for the same offense. Appellee successfully challenged the indictment on double jeopardy grounds.
