OPINION

CANNON, Justice.

Appellant entered a plea of not guilty before a jury to the offense of aggravated assault of a police officer. Tex.Penal Code Ann. § 22.02(a)(2). He was convicted and the jury found that appellant used a deadly weapon, namely a firearm, during the commission of the offense. The court assessed punishment at imprisonment for seven years.
