This is a subrogation suit brought pursuant to former Tex.Rev.Civ.Stat.Ann. art. 8307, § 6a.1 New York Underwriters Insurance Company filed suit against appellant, an alleged third-party tortfeasor, to recover sums which it paid to Gerald James Guillot as workers' compensation benefits.
