Defendant, Benny C. Hayes, was charged through a Grand Jury indictment with the second degree murder of his wife which occurred in May 1983. Pursuant to a plea agreement, defendant pled guilty in October 1983 to attempted second degree murder and was sentenced in accordance with the agreement to 36 years at hard labor.
