OPINION

WOLIN, District Judge.

The Secretary of Labor (the "Secretary") and Local 427, International Union of Electrical, Radio and Machine Workers, AFLCIO ("Local 427") have filed cross-motions for summary judgment. Because there is no genuine issue of material fact, and because the Court agrees with the Secretary's interpretation of the governing statute, the Court will enter summary judgment on behalf of the Secretary.
