MARVIN, Chief Judge.

After being charged with simple burglary, Cecil Bailey appeals his conviction of the attempt of the crime, contending that he was denied effective assistance of counsel and that evidence was insufficient for the jury to find him guilty beyond a reasonable doubt.

The record is sufficient to allow us to consider his first contention of ineffective assistance of counsel. State v. Seay,
