Plaintiff, Penelope Corgan, filed this tort action in the circuit court of Cook County against defendant, Conrad Muehling. Defendant filed a motion to dismiss counts I, III and IV of plaintiff's third-amended complaint, hereinafter referred to as the complaint (Ill.Rev.Stat.1981, ch. 110, par. 2-615).
